Attorneys representing 15-year-old KJ Biermann, the son of television personality Kim Zolciak, are formally challenging the seven felony counts filed against him in Georgia, according to court documents obtained by Page Six and reported by TMZ. Defense counsel Jason Sheffield argues in the filings that prosecutors have failed to present sufficient factual details to substantiate essential elements of the state's case.

Biermann was arrested in August after a female classmate accused him of sexually assaulting her inside a gym changing room in Georgia during an incident that allegedly occurred in April. According to reporting from TMZ, the accuser alleged that Biermann digitally penetrated her and forced her to perform oral sex despite her vocal objections. Biermann was subsequently indicted on seven felony charges and entered a plea of not guilty to all counts in October.

In the defense's recent filings, Sheffield specifically challenges the clarity and substance of the indictment. The attorney contends that the count of aggravated child molestation does not outline what specific physical injury allegedly occurred during the incident. Furthermore, the defense maintains that the charges of aggravated sexual battery and sodomy fail to explain how force was reportedly applied by the teenager.

Biermann's legal team has also directed scrutiny toward three counts of sexual battery, arguing in the court documents that the charges appear virtually identical to one another. Sheffield additionally challenges the false imprisonment count, asserting that prosecutors have not articulated how Biermann allegedly restrained his classmate inside the changing room facility.

In response to these perceived deficiencies, the defense is requesting a formal court hearing and asking that the lead detective in the investigation be called to testify, according to TMZ. Biermann has continued to maintain his innocence as his attorneys push for the state to provide greater detail regarding its evidence.

The case has also drawn scrutiny surrounding prior claims raised by prosecutors during proceedings. Authorities previously asserted that investigators discovered video files on Biermann's phone depicting him engaging in sexual acts with an underage relative. Sheffield strongly contested the prosecution's characterization of that material, describing the earlier situation as inappropriate behavior between middle school students.

Following his August arrest, Biermann spent approximately one month in custody before securing release on bond. Under the conditions of his bond, the 15-year-old is presently confined to his mother Kim Zolciak's home while the legal proceedings continue in Georgia.
