Attorneys for Rep. Ilhan Omar Challenge Federal Home Search, Demanding Seized Belongings Back
Attorneys representing U.S. Rep. Ilhan Omar are demanding the return of property taken from her Washington residence after an October search by federal authorities. The legal team argues that agents breached restrictions established by a judge, an allegation the Justice Department has firmly denied.

Attorneys representing U.S. Rep. Ilhan Omar have lodged a formal challenge against federal authorities following a search of her Washington, D.C., residence, according to reporting by theGrio citing The Washington Post. The Minnesota Democrat’s legal team sent a letter to the Justice Department demanding the prompt return of property taken during the operation, asserting that investigators disregarded restrictions imposed by a judge.
The search was conducted on October 12 by federal agents with Homeland Security Investigations, according to the reported accounts. Authorities carried out the operation in connection with longstanding questions surrounding Omar’s immigration history. Among the items taken from the lawmaker's home were documents, a cellphone, and her passport. Omar, a naturalized U.S. citizen who arrived in the country during childhood, has denied any wrongdoing and denounced the investigation as a politically driven effort.
In their letter to federal officials, Omar’s lawyers alleged that authorities failed to adhere to key parameters set by a magistrate judge prior to the search. According to the legal team, investigators also neglected to provide required notification to Omar’s attorneys and congressional representatives. Her counsel argued that the lack of advance notice prevented the lawmaker from obtaining legal advice regarding constitutional protections afforded to members of Congress.
The legal dispute highlights constitutional safeguards meant to shield legislative work from executive overreach. According to the reporting, a magistrate judge previously warned that an investigation targeting a lawmaker could implicate the Constitution’s Speech or Debate Clause. Omar’s legal team contends that the manner in which the search was executed may have compromised those protections.
The Justice Department has rejected the claims made by Omar’s legal representatives, labeling the accusations false, according to The Washington Post. Disagreements over how the warrant was executed and how seized property should be handled now sit at the center of the ongoing dispute.
The inquiry has drawn renewed attention because Omar’s immigration records were examined in the past. According to The Washington Post, an earlier inquiry into Omar’s background took place during the first Trump administration. That prior review uncovered no evidence of citizenship irregularities and was subsequently dropped.
Omar’s counsel characterized the recent search as an effort directed at a prominent critic of President Donald Trump. While the claims raise serious questions regarding the execution of the search warrant, no court ruling has established misconduct, and the matter remains unresolved.
